This Order in Council implements the recast Banking Directive and the recast Capital Adequacy Directive under which the new capital accord for banks (Basel II) is put into effect for the European Union (EU).

This Order in Council makes changes in particular to the Decree on Prudential Rules under the Wft (Besluit prudentiële regels Wft) and the Decree on the Prudential Supervision of Financial Groups (Besluit prudentieel toezicht financiële groepen) and, on a limited scale, to other Orders in Council under the Financial Supervision Act (Wet op het financieel toezicht / Wft). Articles VII to XII of the Decree on the Implementation of the Basel II Capital Accord (Besluit implementatie kapitaalakkoord Bazel 2) contain transitional provisions. This Order in Council includes a number of supervisory regulations introduced by DNB itself.
