Level 1 (Legislative acts)
At the Commission’s initiative, the Council and the European Parliament draw up legislative acts (Regulation, Directive or Decision). The standard legislative procedure for determining legislative acts is the ordinary legislative procedure (formerly the co-decision procedure).
Level 2 (Non-legislative acts)
In the legislative act (level 1), the Council and the European Parliament may grant the Commission the power to give further substance to the legal act (Regulation, Directive or Decision). If the legal act on level 1 prescribes the comitology procedure, the Commission presents the draft of the non-legislative acts to the European Banking Committee (EBC).
Level 3 (Advices and Guidelines)
The ESA advises the Commission on the preparation of draft non-legislative acts (level 2). Moreover, the ESA draws up Guidelines and Recommendations. This power is granted under the regulation governing the formation of the ESA.
