On 1 July 2008, specific regulations were introduced for the Netherlands with respect to registered covered bonds by emendation of the ‘Besluit prudentiële regels Wft’ [Decree on Prudential Rules for Financial Undertakings], through the Besluit gedragstoezicht financiële ondernemingen Wft [Decree on Conduct of Business Supervision of Financial Undertakings], and through the Uitvoeringsregeling Wft [Regulation Implementing the Financial Supervision Act ]
These regulations set the conditions and minimum requirements that an issuing bank having its registered office in the Netherlands must meet if bonds (to be) issued by that bank are to qualify as covered bonds and may be entered in the public register of covered bonds maintained by DNB.
Such registered covered bonds may also satisfy the requirements of Section 12 of Annex VI of Directive 2006/48/EC (CRD). If they do, this is noted in the Register.
The issuing bank must at all times meet the requirements applying to registered covered bonds. If it ceases to meet those requirements, it must refrain from any further issues of registered covered bonds until it once more meets all applicable requirements.
